Owners Corporation
The Owners Corporation and the OC Committee
Manage and administer the common property.
An Owners Corporation manages the common property of a property whether residential, commercial, retail or industrial.
The Committee of the BYFAS OC is made up of owners elected to assist in the management of BYFAS in conjunction with our strata manager. Members give a great deal of their time on a voluntary basis to assist in the effective functioning and maintenance of our large building and the related interests of residents.
Our ‘Body Corporate’ became an owners corporation on 31 December 2007, when the Owners Corporations Act 2006 came into force. This law sets out the duties and powers of owners corporations.
An Owners Corporation is automatically created when a plan of subdivision containing common property is registered at Land Victoria. Common property may include, for example, gardens, passages, walls, pathways, driveways, lifts, foyers and fences.
When you purchase a property affected by an owners corporation, then you become a member of that Owners Corporation automatically. As a member, you have legal and financial responsibilities to the Owners Corporation.

- Repair and maintain the common property, fixtures and services.

- Raise fees from the lot owners to meet financial obligations.
- Prepare financial statements and keep financial records.
- Provide owners corporations certificates when requested.
- Keep an owners corporation register.
- Establish a grievance procedure.

BYFAS Owners Corporation has engaged Whittles Management Services as its strata manager to administer the day to day operations of the Owners Corporation 1 & 2 for Plan of Subdivision 501242H C.

- Plan files, notices, (eg AGM minutes), correspondence etc
Owners Corporation Fees
Invoices are issued to registered owners by Whittles four times per year.
Two Owners Corporations exist for the Plan of Subdivision (PS501242H) - OC1 which covers insurance of the building and OC2 which covers the operation and maintenance of the BYFAS building eg lifts, rubbish collection, building repairs etc. Separate fees are levied for each OC. The BYFAS building is S1 and the adjacent S2 site is currently under development.
The BYFAS AGM is held annually (usually Aug-Sep). Its purpose is to accept reports from the Owners Corporation Committee and Strata Manager, review financial statements for the past year, agree budgets for the new year and elect the new Committee.
It is recommended all owners attend the AGM to keep up to date on issues affecting their property.
